Information on the processing of personal data

We would like to inform you that in connection with the entry into force on May 25, 2018, of the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation - Official Journal of the EU L 119 - hereinafter: GDPR), B-Art Sp. z o.o. ensures the standards of protection and proper handling of personal data specified in these regulations.

In accordance with Article 13, paragraphs 1 and 2 of the GDPR, we inform the persons whose data the Company holds that:

1) B-Art Sp. z o.o. – registered office: 66-010 Bogaczów, ul. Aleja Lipowa 2 is the Administrator of your personal data, which it has come into possession of as a result of executing contracts with you and handling them, maintaining correspondence, and the substantive handling of orders, requests, inquiries, and complaints sent to us, as well as using video surveillance.

2) The legal bases for the permissibility of processing by B-Art Sp. z o.o. concerning your data are:

to take actions before concluding a contract at the request of the data subject (legal basis: Article 6, paragraph 1, letter b of the GDPR);

for purposes arising from the provisions of concluded contracts (legal basis: Article 6, paragraph 1, letter b of the GDPR);

to document the service or contract performed, or to consider and resolve complaints based on obligations arising from the Accounting Act and tax law provisions, as well as to fulfill other obligations arising from legal regulations (legal basis: Article 6, paragraph 1, letter c of the GDPR);

for analytical purposes and customer satisfaction research regarding the proper manner of providing services for our Company's clients and optimizing their service processes, which constitutes a legitimate interest of the Data Administrator (legal basis: Article 6, paragraph 1, letter f of the GDPR);

to update and correct clients' personal data, as well as to contact clients regarding the implementation of their requests, within the framework of the legitimate interest of the Data Administrator (legal basis: Article 6, paragraph 1, letter f of the GDPR);

for evidential purposes as part of the legitimate interest of the Data Administrator to secure information in the event of a legal need to demonstrate facts (legal basis: Article 6, paragraph 1, letter f of the GDPR);

to potentially establish, pursue claims, or defend against claims as part of the legitimate interest of the Data Administrator (legal basis: Article 6, paragraph 1, letter f of the GDPR);

to ensure the safety of persons and property on the premises of B-Art Sp. z o.o. by using video surveillance and controlling pedestrian and vehicular traffic.

for marketing its own services and promoting the Company's activities and its new initiatives among clients related to B-Art Sp. z o.o. contracts (legal basis: Article 6, paragraph 1, letter a of the GDPR, Article 6, paragraph 1, letter f of the GDPR, and relevant provisions regarding electronic communication);

  1. Your personal data is not subject to automated decision-making by B-Art Sp. z o.o., including profiling.
  2. Individuals whose data our Company processes have the following rights:

access to their data and to receive a copy of it,

rectification (correction) of data,

erasure of data (in accordance with the conditions specified in Article 17 of the GDPR),

to restrict the processing of data (in accordance with the conditions specified in Article 18 of the GDPR),

to data portability (in accordance with the conditions specified in Article 20 of the GDPR),

to object to the processing of data (in accordance with the conditions specified in Article 21 of the GDPR),

to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office.

  1. B-Art Sp. z o.o. will store your personal data:

for the period necessary to perform the contract / provide the service and to pursue claims or defend against claims, i.e., for a period of 10 years, or until the statute of limitations for claims expires;

in the case of processing data for the purpose of fulfilling the legitimate interest of the Data Administrator for the period until the objection is raised by the data subject, subject to the necessity of processing data until the end of the period necessary to establish, pursue claims or defend against claims;

in the case of processing data based on the consent of the person in the event of withdrawal of consent by that person (in the absence of another legal basis for processing) or filing an objection (we will cease processing data for the purposes specified in the consent declaration).

Furthermore, we will retain proof of consent for 10 years for the purposes of demonstrating facts in the event of any claims regarding the improper processing of personal data by us.

  1. Your personal data may be disclosed to public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for the purposes resulting from applicable law, as well as to subcontractors related to B-Art Sp. z o.o. under data processing agreements, e.g., law firms, companies providing IT services to the Company, debt collection agencies, personal and property protection agencies.
  2. The Company, as the Data Administrator, declares that it does not transfer and does not intend to transfer personal data to a third country or international organization.
