Information on the Processing of Personal Data

We would like to inform you that, in connection with the entry into force on May 25, 2018, of the provisions of the European Parliament and Council Regulation (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – Official Journal of the EU L 119 – hereinafter: GDPR), B-Art Sp. z o.o. ensures the protection and proper handling of personal data as outlined in these provisions.

Pursuant to Article 13, sections 1 and 2 of the GDPR, we inform individuals whose data is held by the company that:

  • B-Art Sp. z o.o. – registered office: 66-010 Bogaczów, Aleja Lipowa 2, is the Data Controller of your personal data, which it has obtained as a result of executing agreements with you, handling correspondence, and managing the orders, requests, appeals, and complaints sent to us, as well as using video surveillance.

  • The legal grounds for processing your data by B-Art Sp. z o.o. are:

    • to take steps prior to entering into a contract at the request of the data subject (legal basis: Article 6(1)(b) GDPR);
    • for the performance of the contract (legal basis: Article 6(1)(b) GDPR);
    • to document services performed or contracts executed, or to address and resolve complaints based on obligations arising from accounting law and tax regulations, and to fulfill other legal obligations (legal basis: Article 6(1)(c) GDPR);
    • for analytical purposes and customer satisfaction research to ensure proper service delivery and optimize service processes, which constitutes the legitimate interest of the Data Controller (legal basis: Article 6(1)(f) GDPR);
    • to update and correct customer personal data, as well as contact customers regarding the implementation of their requests, based on the legitimate interest of the Data Controller (legal basis: Article 6(1)(f) GDPR);
    • for evidentiary purposes to secure information in case of a legal need to demonstrate facts (legal basis: Article 6(1)(f) GDPR);
    • for potential claims establishment, pursuit, or defense, which is the legitimate interest of the Data Controller (legal basis: Article 6(1)(f) GDPR);
    • to ensure the safety of people and property on the premises of B-Art Sp. z o.o. through the use of video surveillance and control of pedestrian and vehicle traffic;
    • for marketing purposes of our own services and promoting the company's activities and new initiatives among clients related to B-Art Sp. z o.o. contracts (legal basis: Article 6(1)(a) GDPR, Article 6(1)(f) GDPR, and applicable provisions on electronic communication).
  • Your personal data will not be subject to automated decision-making, including profiling, by B-Art Sp. z o.o..

  • Individuals whose data is processed by our company have the following rights:

    • to access their data and receive a copy;
    • to rectify (correct) data;
    • to erase data (subject to conditions outlined in Article 17 GDPR);
    • to restrict data processing (subject to conditions outlined in Article 18 GDPR);
    • to transfer data (subject to conditions outlined in Article 20 GDPR);
    • to object to data processing (subject to conditions outlined in Article 21 GDPR);
    • to file a complaint with the supervisory authority, which is the President of the Personal Data Protection Office.
  • B-Art Sp. z o.o. will store your personal data:

    • for the period necessary to perform the contract/service and to pursue or defend claims, i.e., for 10 years, or until the claims are barred;
    • if data is processed for the legitimate interest of the Data Controller, until the data subject objects, subject to the need to process data until the end of the period necessary to establish, pursue, or defend claims;
    • if data is processed based on the consent of the data subject, upon withdrawal of consent (in the absence of other legal grounds for processing) or objection, we will cease processing data for the purposes specified in the consent declaration. Furthermore, we will store proof of consent for 10 years for the purpose of demonstrating facts in case of potential claims regarding improper processing of personal data.
  • Your personal data may be shared with public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for purposes required by applicable law, as well as subcontractors related to B-Art Sp. z o.o. under data processing agreements, such as law firms, IT service companies, debt collection agencies, and security agencies.

  • As the Data Controller, the company declares that it does not and does not intend to transfer personal data to a third country or international organization.
